Paternity
The goal of a paternity action is to establish the paternity of a child, as well as set forth the rights and responsibilities of the father. Those rights may include visitation, while the responsibilities may include child custody and support. Usually, a paternity action is only needed when a child is born outside of marriage and the father is not named on the child's birth certificate.
At Plasencia & Associates, we understand the importance of family relationships and always work together with our clients to find common ground that benefits all concerned.
Every case is different
In addition, we recognize that every paternity case is different. For example, often a mother needs to learn who the father of her child is so that she can receive the support to which she is entitled. In other cases, a father wants to learn if a child is his so that he can fulfill his financial and other responsibilities.
Whatever the situation, Plasencia & Associates is here to help.
Paternity and child support obligations
Paternity must be legally established before a father is ordered to pay child support. Thus, if a mother requests support, she must first go through a paternity action to prove an individual is the father of the child. For his part, the individual she believes to be the father must undergo DNA testing to determine whether he is liable to pay support.
Once paternity is established, the child also gains inheritance rights and can receive health care benefits under the insurance coverage of the father.
The chance to build a connection
Beyond financial considerations, though, every child should have the chance to build a strong relationship with both parents. Establishing paternity enables a father to request visitation rights through the court, and to build a loving connection with his child.
